Booking Terms & Conditions

Please read these terms carefully before booking a safari with us. These terms govern your use of our services and website.

1. Agreement to Terms

By accessing or using the TravelCats Africa Safaris website ("Website") or booking services through TravelCats Africa Safaris Limited ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

We reserve the right to modify these Terms at any time. Your continued use of our services after changes are posted constitutes your acceptance of the modified Terms.

2. Our Services

TravelCats Africa Safaris provides safari booking and travel planning services in Kenya, including:

  • Safari package bookings and custom itinerary planning
  • Accommodation reservations at lodges and camps
  • Transportation and transfer arrangements
  • Guide services and tour coordination
  • Travel consultation and quote services
  • Payment processing and booking management

We act as an intermediary between you and third-party service providers (lodges, camps, transport operators, guides). We are not responsible for the acts, errors, omissions, or conduct of these third parties.

3. Booking Process

3.1 Making a Booking

To make a booking, you must:

  • Provide accurate and complete information
  • Be at least 18 years old or have parental consent
  • Have the legal authority to enter into binding agreements
  • Ensure all travelers meet entry requirements (passports, visas, vaccinations)

3.2 Booking Confirmation

A booking is confirmed only when:

  • You receive a written confirmation email from us
  • Required deposit or full payment has been received
  • All necessary travel documents are verified

Please review your booking confirmation carefully and notify us immediately of any errors.

3.3 Pricing

All prices are quoted in the currency specified and are subject to change until booking is confirmed. Prices may vary based on:

  • Season and availability
  • Number of travelers
  • Accommodation category selected
  • Additional services requested
  • Currency exchange rate fluctuations

We reserve the right to correct pricing errors, even after confirmation. If an error is discovered, we will notify you and offer the option to proceed at the correct price or cancel with a full refund.

4. Payment Terms

4.1 Payment Schedule

Payment terms vary by booking:

  • Deposit: Typically 30-50% of total cost, required to secure booking
  • Balance: Due 30-60 days before travel date (varies by package)
  • Last-Minute Bookings: Full payment may be required immediately

4.2 Payment Methods

We accept payments via:

  • Credit and debit cards (Visa, Mastercard) through secure payment processors
  • M-Pesa mobile money (Kenya)
  • Bank transfers (details provided upon booking)
  • Other methods as agreed upon

4.3 Late Payments

If payment is not received by the due date, we reserve the right to cancel your booking and apply cancellation fees as outlined in Section 5. We will attempt to contact you before cancellation.

5. Cancellation and Refunds

5.1 Cancellation by You

Cancellation fees apply as follows (unless otherwise stated in your booking confirmation):

  • 60+ days before travel: Deposit forfeited (typically 30-50% of total)
  • 30-59 days before travel: 50% of total cost
  • 15-29 days before travel: 75% of total cost
  • Less than 15 days before travel: 100% of total cost (no refund)

Cancellation requests must be made in writing (email) and will be effective from the date we receive your request. Refunds, if applicable, will be processed within 14-30 business days.

5.2 Cancellation by Us

We reserve the right to cancel bookings due to:

  • Force majeure events (natural disasters, pandemics, political unrest)
  • Insufficient bookings (group tours)
  • Unforeseen circumstances beyond our control
  • Non-payment or breach of these Terms

If we cancel your booking (except due to your breach), we will offer a full refund or alternative arrangements. We are not liable for additional expenses you may incur (flights, visas, etc.).

5.3 Changes by You

Changes to bookings (dates, travelers, services) are subject to availability and may incur fees:

  • Administrative fees may apply
  • Price differences if upgrading services
  • Supplier penalties for changes

Changes must be requested in writing. We will confirm feasibility and any additional costs.

6. Travel Requirements and Responsibilities

6.1 Travel Documents

You are responsible for:

  • Valid passport (minimum 6 months validity)
  • Required visas and entry permits
  • Vaccination certificates (yellow fever, COVID-19, etc.)
  • Travel insurance (strongly recommended)
  • Any other documents required by authorities

6.2 Health and Safety

You must:

  • Disclose any medical conditions or special requirements
  • Follow safety instructions from guides and staff
  • Comply with park rules and regulations
  • Respect wildlife and environment
  • Obtain appropriate travel insurance

6.3 Travel Insurance

We strongly recommend comprehensive travel insurance covering: medical expenses, trip cancellation, personal liability, and emergency evacuation. We are not responsible for any costs incurred due to lack of insurance.

7. Liability and Limitations

7.1 Our Liability

To the maximum extent permitted by law:

  • Our liability is limited to the total cost of your booking
  • We are not liable for indirect, consequential, or special damages
  • We are not responsible for acts of third-party service providers
  • We are not liable for force majeure events or circumstances beyond our control

7.2 Wildlife and Nature

Wildlife viewing is subject to natural conditions. We cannot guarantee specific animal sightings, weather conditions, or migration timing. Safari experiences may vary.

7.3 Your Liability

You are liable for:

  • Damage to property or equipment
  • Injury to yourself or others due to negligence
  • Additional costs due to non-compliance with requirements
  • Losses due to providing inaccurate information

8. Website Use

When using our website, you agree to:

  • Use the website only for lawful purposes
  • Not attempt to gain unauthorized access to our systems
  • Not transmit viruses, malware, or harmful code
  • Not copy, reproduce, or distribute content without permission
  • Respect intellectual property rights

9. Intellectual Property

All content on our website, including text, images, logos, and design, is owned by TravelCats Africa Safaris Limited or our licensors and is protected by copyright and trademark laws. You may not use, reproduce, or distribute our content without written permission.

10. Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

11. Dispute Resolution

If you have a complaint, please contact us first. We will attempt to resolve disputes amicably. If resolution cannot be reached, disputes will be subject to the exclusive jurisdiction of the courts of Kenya, governed by Kenyan law.

12. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, strikes, government actions, or other force majeure events.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
